These Terms & Conditions ("Terms") govern your use of the GotOneForYa platform and website at gotoneforya.com, operated by GotOneForYa LLC ("GotOneForYa," "we," "us," or "our"). By using our services, you agree to these Terms.
The Service
GotOneForYa is a platform that helps independent guitar shops manage customer want lists and send automated SMS notifications when matching inventory arrives. There are two types of users:
- Shop Owners subscribe to GotOneForYa to manage want lists for their business.
- Customers submit want list requests through a participating shop and receive SMS notifications about matching inventory.
For Customers (Want List Participants)
Submitting a want list request. When you submit a want list request through a participating guitar shop, you provide a description of the guitar or gear you're looking for, your phone number, and your consent to receive text messages. Your request is associated with that specific shop.
SMS notifications. By submitting your phone number and checking the consent box, you agree to receive text messages from GotOneForYa on behalf of the participating shop. Messages include want list confirmations and inventory match notifications. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time. Reply HELP for support. Your consent to receive messages is not a condition of any purchase.
Matching is a suggestion, not a guarantee. GotOneForYa uses technology to match your want list request against a shop's inventory. Matches are suggestions based on your description and may not be exact. We do not guarantee that any particular item will become available, that a match will meet your expectations, or that an item will still be available when you contact the shop.
Transactions are between you and the shop. GotOneForYa does not sell guitars or gear. Any purchase, negotiation, pricing, return, or dispute is between you and the shop. We are not a party to any transaction.
For Shop Owners
Account and access. As a shop owner, you are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
Your customer data. You are responsible for your relationship with your customers, including ensuring that your use of GotOneForYa complies with applicable laws. You must not use the platform to send messages that your customers have not consented to receive.
Acceptable use. You agree to use GotOneForYa only for its intended purpose — managing want lists and notifying customers about matching inventory at your guitar shop. You may not use the platform to send marketing messages unrelated to want list matches, spam, or any content that violates applicable law.
Subscription and payment. Shop owner access to GotOneForYa is provided on a subscription basis. Pricing, billing terms, and any trial or pilot periods will be communicated to you separately. We reserve the right to change pricing with reasonable notice.
Your content. You retain ownership of the inventory data and customer information you provide through GotOneForYa. By using the platform, you grant us a limited license to process this data solely to operate the service on your behalf.
General Terms
No warranty. GotOneForYa is provided "as is" and "as available." We make no warranties, express or implied, regarding the reliability, accuracy, or availability of the service. We do not warrant that matches will be accurate, that notifications will be delivered without delay, or that the service will be uninterrupted.
Limitation of liability. To the fullest extent permitted by law, GotOneForYa LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the service. Our total liability for any claim shall not exceed the amount you paid to us in the twelve months preceding the claim, or $100, whichever is greater.
Indemnification. You agree to indemnify and hold harmless GotOneForYa LLC from any claims, damages, or expenses arising from your use of the service, your violation of these Terms, or your violation of any applicable law.
Modifications to the service. We may modify, suspend, or discontinue any part of GotOneForYa at any time. We will make reasonable efforts to notify affected shop owners in advance of material changes.
Changes to these Terms. We may update these Terms from time to time. If we make material changes, we will update the "Last Updated" date at the top of this page. Continued use of the service after changes are posted constitutes acceptance of the updated Terms.
Governing law. These Terms are governed by the laws of the State of Colorado, without regard to its conflict of laws provisions.
Termination. We may suspend or terminate your access to GotOneForYa at any time for violation of these Terms. Shop owners may cancel their subscription at any time by contacting us. Upon termination, we will delete your data in accordance with our Privacy Policy.
